연동형 비례대표제 법안에 대한 입법평론

그간의 선거제도 개혁에서는 국회의원의 증원, 중대선거구제, 양원제, 비례대표 의석수의 증대와 권역별 비례대표제, 석패율 제도 등이 논의 주제였는데, 대부분의 선거제도 개혁방안들은 실현되지 못하였다. 헌법의 개정을 요하는 것은 별론으로 하더라도 공직선거법의 개정을 통한 선거제도의 개혁은 현역 국회의원들의 기득권이나 각 정당의 이해득실과 무관할 수 없기 때문에 공직선거법을 개정하기가 쉽지는 않다. 그러나 소선거구 다수대표제와 비례대표제의 문제점에 대한 인식을 공유하고 있다면, 당위론적 관점에서 연동형 비례대표제 특히 권역별 연동형 비례대표제의 도입을 신중하게 검토할 때가 되었다고 본다. 연동형 비례대표제 도입 등을 내용으로 하는 제19대 국회에서의 공직선거법 개정안은 임기만료로 모두 폐기되었고, 제20대 국회에서도 연동형 비례대표제 도입을 내용으로 하는 공직선거법 개정안이 다수 발의되어 있다. 이들 법안들은 권역으로 하건 전국을 대상으로 하건 연동형 비례대표제의 도입을 내용으로 하고 있고 대개의 법안에서는 지역구 의석과 대비하여 비례대표의석을 확대하자는 내용을 두고 있다. 그러나 비례대표 의석수를 늘리고 비례대표의석의 배정을 권역별로 결정하는 방안은 현실정치와의 연관성이 민감하기 때문에 필요성이나 당위성과는 별개로 공직선거법이 개정되어 연동형 비례대표제가 도입될지 여부에는 의문이 제기되고 있다. 그러나 현실적인 어려움이 있더라도 바람직한 선거제도와 정치개혁을 위해서 그리고 정당의 득표와 의석수의 불비례를 통한 선거결과의 왜곡을 시정하기 위한 최소한의 개선이라도 이루어져야 한다는 주장에 설득력이 있다. 이에 더하여, 정치개혁은 선거제도만 개선된다고 해결되지 않는다. 공천과정의 우려와 문제점을 해소할만한 정당제도의 개혁이 이루어지지 않는다면 선거제도의 개혁은 오히려 개악이 될 수도 있다. 현재와 같이 폐쇄형 명부식으로 비례대표제를 작성하는 경우 즉 하향식 공천의 경우에는 정당 공천과정의 투명성과 공정성이 보장되기 어렵다. 따라서 비례대표 의석수를 늘이는 경우에는 공천과정의 투명성과 공정성이 더욱 보장되는 정당제도의 개혁이 동반되어야 할 것이다.

The legislative review on the bills of the mixed proportional election system

Under the present election system, the National Assembly is composed of members elected from individual electoral districts and proportional representatives from a national constituency. According to the Public Election Act, the national Assembly has 300 members with 253 elected and 47 proportional representation seats. The Public Election Act adopts the proportional representation system in National Assembly election. The electoral district of a proportional representative consists of the entire nation. Since the election of proportional representatives in the National Assembly and the election of district assembly person are two different elections, the voter should be allowed to cast two separate ballots, one for his or her favorite candidate in the electoral district and the other for the political party of his or her choice. The current Public Election Law featuring single-member constituencies has long been blamed for failing to reflect voters' preferences because there is a large gap between the votes a party gets and its actual number of seats. Many voters demand the reform of the Public Election Act for the National Assembly election system to better reflect voters' party preferences. One of the reform agenda of the President Moon and the current ruling political party is the introduction of the regional proportional election system. To achieve this proportional electoral system reform, is the revision of the Public Election Act needed. The 5 bills on the Public Election Act plan to reform the current public election system. According to the new proportional electoral system, the number of National Assembly seats will be determined in proportion to the total number of votes a party's candidate wins in the general election. The success of such electoral system reform depends on whether the political parties can decide beyond their partisan interests. The parties should listen to the voices of the people for a better electoral system.
