헌법상 비례성 원칙 : 프랑스 헌법재판소를 중심으로

프랑스에서는 오늘날 헌법재판소가 법률의 합헌성 심사를 통해 다른 권력의 억지에 일정한 역할을 다하게 되어 있다. 이는 법률제정을 담당하는 입법권에 대해서만이 아니라 법률안의 제출이 주로 정부에 의한 것이 많다는 점에서 행정권에 대한 억제 효과도 가지고 있다. 권력분립은 인권보장의 필연이라고 하지만, 권력의 억제가 적절하게 효과적으로 이루어지지 않으면 의미가 없다. 프랑스 헌법재판소의 역할은 1962년 11월 6일의 판결 중에서 자신들의 임무를 「공권력 활동의 조절기관」으로 자리매김 함으로써 명백하게 되었다. 게다가 1974년 10월 29일의 헌법개정으로 의회 내 소수파에 의해 헌법재판소에 제소를 할 수 있게 되면서 그 역할은 권리나 자유의 보호까지 할 수 있도록 보다 확대할 수 있게 된 것이었다. 그 이후 많은 헌법 판결을 내리면서 일정한 심사기준을 모색해 왔다. 그 중에서도 비례성 원칙은 한국 헌법상 과잉금지의 원칙 내지 비례의 원칙과 유사한 헌법상 인정되는 원칙이며, 그 근거나 내용 등을 연구하는데 그 의미가 있다고 생각된다. 프랑스의 헌법상 비례성의 원칙과 심사의 특징을 다음과 같이 정리할 수 있다. 즉, 「계층성의 최상위에서의 심사는 항상 완전심사로 행해진다. 이 대상이 되는 것은 커뮤니케이션의 자유, 단체행동권, 선거권, 재판을 받을 권리 등이다. 계층성의 중간에서는 중대한 침해가 있는 경우에만 완전심사가 행해진다. 이 대상이 되는 것은 협의의 개인적 자유이며 광의의 개인적 자유 역시 동일한 것이다. 그리고 이러한 비례의 원칙은 프랑스에서는 행정법의 분야에서도 적용되며, 이 또한 프랑스 행정법상 기본원리라고 할 수 있다.

Principle of proportionality in the Constitution : Focused on the Constitutional Court of France

In France today, the Constitutional Court is required to play a certain role in the suppression of other powers through a review of the constitutionality of the law. This has the effect of suppressing administrative power not only for the legislative power in charge of legislation but also for the fact that the submission of legislation is mainly made by the government. The separation of power is said to be a necessity for the guarantee of human rights, but it is meaningless if power control is not done properly and effectively. The role of the French Constitutional Court became apparent in its ruling on November 6, 1962, when it established its mission as a "regulator of public power activities." Furthermore, the constitutional amendment on October 29, 1974 allowed a minority in parliament to file a complaint with the Constitutional Court, allowing it to expand its role to protect its rights and freedom. Since then, it has sought certain criteria for screening, handing down many constitutional rulings. Among them, the principle of proportionality is a constitutionally accepted principle similar to the principle of excessive prohibition or proportionality under the Korean Constitution, and it is believed to be meaningful in studying the basis and contents of the principle. The principle of proportionality and the characteristics of examination in French constitution can be summarized as follows: In other words, the review at the top of the hierarchy is always conducted as a full review. The targets include freedom of communication, the right to collective action, the right to vote and the right to stand trial. In the middle of hierarchicality, a full review is made only if there is a significant infringement. To be subject to this is the personal freedom of consultation and the same is true of broad personal freedom. And this principle of proportion applies in the field of administrative law in France, which is also the basic principle of French administrative law.
