독일의 디지털 뉴스저작물 보호를 위한 법제동향

제4차 산업혁명으로 인한 정보통신 기술의 발전은 뉴스 생태계(생산·유통·소비)에 새로운 변화를 일으켰다. 즉, 뉴스를 생산하여 소비자에게까지 전달하는 과정이 동일한 주체에 의해 이뤄지면서 생산자와 소비자가 뚜렷이 분리되어 단방향적이며 양분화되었던 과거와 달리, 인터넷 뉴스를 생산하는 언론·유통하는 온라인서비스제공자·이용자(소비자)의 구조로 변화되고, 나아가 이들의 역할이 서로 바뀌는 프로슈머(prosumer)가 등장하게 되었다. 특히, 구글(Google)과 같은 거대 플랫폼사업자는 다양한 뉴스 기사의 헤드라인 또는 리드(ledes)를 이용자들에게 제공하며, 더 상세한 뉴스 기사를 원하는 이용자에게는 직접링크 방식으로 언론사 등의 웹페이지로 이동 가능하게 하는 애그리게이터(aggregator) 서비스를 제공하고 있다. 이것은 지금까지 언론사 고유의 영역으로 인식되던 뉴스의 생산과 유통의 역할을 잠식 또는 대체하는 것이다. 그런데 이처럼 새롭게 등장한 애그리게이터 서비스와 관련하여 규제 가능한 법제를 찾기 어려운 실정이다. 이에, 각국마다 이러한 현상에 대응하고자 하는 다양한 움직임이 포착되고 있다. 특히, 유럽연합이 2019년 「EU 디지털 단일시장 저작권지침」(이하, DSM 저작권 지침이라 함)을 공표함에 따라, 이 표준법안을 참조하여 2년 이내 각국의 실정에 맞게 수정하여 국내법으로 수용해야 하는 유럽연합 회원국, 특히 독일의 법제동향 및 이를 둘러싼 논쟁에 대한 고찰은 유사한 상황에 처한 우리에게 시사하는 바가 크다고 생각된다. 따라서 본 논문에서는 독일의 디지털 뉴스저작물에 대한 권리 보호제도 및 뉴스저작물의 공정한 이용 보장, 그리고 권리와 이용의 균형을 위한 제도와 관련한 최근 동향에 대해 살펴봄으로써, 이에 대한 우리나라의 시사점에 대해 고찰해 보았다.

Current Trends of Legal Regulations for Protection of the Digital News Work in Germany

The development of information and communication technology caused by the 4th Industrial Revolution brought about a new change in the news ecosystem (production, distribution, and consumption). In other words, unlike in the past, when the process of producing and delivering news to consumers was carried out by the same subject, producers and consumers were clearly separated and unidirectional and divided), and furthermore, prosumers, whose roles change with each other, emerged. In particular, giant platform operators such as Google provide headlines or leads of various news articles to users, and users who want more detailed news articles can go to webpages such as media companies by direct link method. It provides an aggregator service that makes it possible to do so. This is to erode or replace the role of news production and distribution, which has been recognized as a unique area of ​​the media so far. However, it is difficult to find a legal system that can be regulated in relation to the newly emerged aggregator service. Accordingly, various movements to cope with this phenomenon are being captured in each country. In particular, in 2019, 「Directive on Copyright in the Digital Single Market (DIRECTIVE (EU) 2019/790 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96 /9/EC and 2001/29/EC)」, referencing this standard law and revising it according to the circumstances of each country within two years and receiving it as domestic law. I think the consideration of the debate has great implications for us in similar situations. Therefore, this paper examines the recent trends in Germany's rights protection system for digital news works, guarantees fair use of news works, and the system for a balance between rights and use, and examines Korea's implications for this.
