헌법상 이중처벌금지원칙의 내용과 그 적용

헌법 제13조 제1항은 이중처벌금지원칙을 선언하고 있다. 국가의 형벌권 행사로서 처벌은 그 자체로 신체의 자유 등 개인의 자유와 권리를 심각하게 제약한다. 처벌에 이르는 과정인 수사와 기소, 공판 등 형사사법의 절차 역시 그 대상인 국민에게 정신적・육체적으로 매우 큰 불편과 부담을 준다. 그러나 범죄로 인한 공동체 구성원 간의 법적 갈등과 혼란이 공정하고 신속한 형사사법의 절차를 통해 판결로써 종국적으로 해소될 때, 비로소 국가형벌권의 궁극적 목적인 공동체의 법적 안정성과 법적 정의가 실현될 수 있다. 그래서 국가형벌권이 하나의 범죄로 평가될 수 있는 행위에 대해 원칙적으로 한 번의 절차와 한 번의 재판을 통해 행사됨으로써 그 대상인 개인은 반복적이고 과중한 형사처벌의 위협으로부터 종국적으로 해방될 수 있고, 공동체의 법적 평화도 실현될 수 있다. 이중처벌금지원칙은 단순히 확정판결의 효력을 헌법적으로 확인하는 정도의 차원을 넘어, 법치국가원리의 핵심적 내용으로서 법적 안정성의 확보 및 법적 정의의 실현, 궁극적으로는 국민의 자유와 권리를 보장하는 것에서 그 규범적 의미를 찾아야 한다. 그러나 이중처벌금지원칙에 대한 이론적 논의나 실무적 이해는 매우 제한적이고 협소한 차원에 머물고 있다. 절차법상 일사부재리원칙이나 판결의 효력으로서 기판력과 동일한 것으로 이해한다. 그래서는 불이익재심을 도입한다거나 법률적 근거도 없이 법률해석을 통해 기판력의 범위를 좁힘으로써 형사재판을 받은 사람의 기본권적 지위를 불안정하게 하더라도 이에 대해 아무런 방어를 할 수 없게 된다. 이 글은 이와 같은 문제의식에서 헌법에서 직접 보장하는 이중처벌금지원칙의 내용과 그 적용의 문제를 검토하는 것을 목적으로 한다.

A Study on the Contents and Application of the principle for Prohibition of double punishment in the constitution

Article 13 (1) of the Constitution declares the principle for Prohibition of double punishment. As the exercise of the state's power to punishment, punishment itself seriously restricts individual freedom and rights, such as personal liberty. The criminal justice procedures such as investigation, prosecution, and trial, which are the processes of punishment, also give very mental and physical inconvenience and burden to the people who are subject to them. However, when legal conflicts and confusion among community members due to crime are finally resolved by a judgment through a fair and prompt criminal justice process, legal stability and legal justice of the community, the ultimate purpose of the state's power to punishment, can be realized. Therefore, the individual subject to the act of state'sl punishment can be evaluated as a crime in principle through one procedure and one trial, so that the individual can be finally liberated from the threat of repeated and heavy criminal punishment, and the legal peace of the community can be realized. The principle for Prohibition of double punishment should be found to have a normative meaning in securing legal stability and realizing legal justice as the core content of the rule of law, and ultimately guaranteeing the freedom and rights of the people, beyond the level of simply confirming res iudicata as the effect of the final judgment. However, theoretical discussions and practical understanding of the principle for Prohibition of double punishment remain very limited and narrow. It is understood that it is the same as ‘Ne bis de in idem’ or ‘res iudicata’ the substrate power as the effect of ‘res iudicata’ or the judgment in the procedure act. Therefore, even if the basic rights of the person who has been judged by criminal justice are unstable by narrowing the scope of ‘res iudicata’ through legal interpretation without legal grounds or introducing criminal retrial system appeals against the benefit of the accused. This article aims to examine the contents of the principle for Prohibition of double punishment guaranteed directly by the Constitution and the problems of its application.
