국민의 의무이행을 확보하기 위한 입법론적 연구
우리나라 국민은 의무를 지켜야 할까? 헌법과 법률은 국민에게 의무를 부여하고 있다. 이에 따라 국민은 필요한 경우 의무를 이행하기도 한다. 이러한 의무 중에는 반드시 지켜야 하는 의무와 지키지 않아도 되는 의무가 있다. 이 둘의 차이는 처벌 규정이 있고 없고의 차이이다. 처벌규정이 있는 의무는 이행하지 않는 경우 처벌 받기 때문에 지키는 것이고 처벌규정이 없는 의무는 이행하지 않아도 처벌하지 않기 때문에 국민은 의무이행을 선택할 수 있다. 우리는 일반적으로 의무라 하면 국민의 4대 의무를 이야기한다. 최근엔 환경주의 의무를 강조하기도 하지만 이는 강제 규정은 아니다. 국민의 4대 의무는 이행하지 않을 경우 처벌받기 때문에 국민은 의무를 이행하고 있다. 법률의 홍수 속에서 살고있는 현실에서 처벌하지 않는 의무 규정을 두어 법률의 개수를 늘리는 것 보다는 굳이 지키지 않아도 되는 의무라면 법에서 삭제하여 입법낭비를 막는 것도 필요하다.
A Study on the Legislation for Securing the Fulfillment of Obligation by People
Should the people of our nation meet obligations? Both Constitution and law give people the obligations. Accordingly, there are cases in which people fulfill the obligation if they need to. Among these obligations, there are two types of obligations, one is that we must fulfill and the other is that we don’t have to fulfill. The difference between them is whether there are punishment regulations or not. The obligation with punishment regulations should be met because of the penalty which people take in case they fail to meet the obligation. But because there is no penalty when people fail to meet the obligation with no punishment regulations, people can make a choice whether to fulfill or not. People generally mean the four major obligations of citizens when they are talking about obligations. Recently there is an emphasis on environmentalism but it is not mandatory regulations. In case people fail to fulfill the four major obligations of citizens, they are punished by the law. That’s why people fulfill the obligations. It is necessary to stop waste of legislations by leaving out the obligations which people don't have to meet rather than increasing the number of laws under the circumstances of living in a flood of legislations.
