「도로교통법」상의 법률용어 개념의 불명확성에 관한 검토
법이 추구하는 목적인 국민을 보호하기 위하여는 누구나 이해하기 쉽게 법이 제정되어야 한다. 또한 법은 사회현상을 그대로 반영하여 사회현실에 부합하는 제도로 규정되어야 법이 살아있는 제도로서 기능을 하게 된다. 현대생활에서 도로교통은 우리 일상에서 가장 많이 접하고 교통수단으로 이용하는 제도이다. 이러한 도로교통은 그 이용가치 만큼 피해가 심각하게 발생하고 있다. 우리나라의 경우 1년에 교통사고 사망하는 수가 4천여명 전후로 여전히 OECD국가 중에서도 높은 피해 수를 나타나고 있다. 이처럼 교통사고로부터 피해를 방지하기 위하여 ｢도로교통법｣이 다양한 법규위반행위를 규정하고 있다. ｢도로교통법｣이 규정하고 있는 내용은 법규위반행위와 함께 각종 규제적인 내용으로 구성되어 있다. ｢도로교통법｣이 가지고 있는 규제적 내용과 위반행위에 대한 내용 등은 사회구성원이 이를 쉽게 이해할 수 있어야 한다. 사회구성원이 도로교통에 대해 이해를 할 수 있도록 하기 위해서는 법이 쉽고 현재 일상생활에서 사용되고 있는 용어로 규정되는 것이 법이 추구하고 있는 목적을 효율적으로 달성할 수 있다. 따라서 ｢도로교통법｣은 이 법에서 추구하고 있는 목적을 달성하기 위하여 그 법률용어가 명확하고 이해하기 쉽게 규정되어야 한다. 법이 명확히 규정되고 사회구성원 모두가 이해할 수 있게 규정될 경우 그 법은 존재가치를 가지며, 법의 명확성 확보로 인하여 법치주의를 달성될 수 있다. 이러한 법치주의 달성을 도로교통법의 법률용어의 특징과 문제점을 분석하여 개선방안을 제시하였다.
A review on the legal terms of Road Traffic Law
The purpose law pursues is to protect the people so law should be understood easily by the people. Also, law should be regulated according to realty by reflecting social phenomena to it. By doing that, the law can operate as living one. In our modern lives, Road Traffic Law is one of the most used traffic institutions which are accessed by a majority of people. However, traffic road causes lots of loss as serious as its value of being used is high. For example, the number of death from car accidents per year accounts to 40,000, which ranks high among OECD nations. For this reason, Road Traffic Law stipulates various traffic offenses to prevent car accidents in advance. For instance, it arranges a variety of regulations as well as specific traffic offenses. The regulations and traffic offenses specified by Road Traffic Law should be simply figured out by the public. In order to come true it, law should be stated in common words that people use in their daily lives. Thus, the legal terms of Road Traffic Law should be stated simply and clearly to achieve the purpose law pursues. When all social members can know what law stipulates, the law is worthy to exist, leading to attaining rule of law. Therefore, this study analysed characteristics and problems of legal terms of Road Traffic Law and suggested alternatives to come true rule of law.
