집회 및 시위에 관한 법령상 집회‧시위 소음 측정 규정 중심의 입법적 개선방안
헌법상 집회‧시위 시 유발되는 소음에 대해서는 원칙적으로 보장해 주어야 하지만, 예외적으로 집회‧시위자 또는 그 상대편 측의 집회‧시위자의 집회의 자유와 해당 집회‧시위 장소의 인근 주민이나 상인 또는 직장인들의 사생활의 자유나 평온권 또는 휴식권 또는 수면권이나 영업권 등에 심각한 피해나 손해를 끼칠 경우에는 필요 최소한의 범위 내에서 집회‧시위 법령에서 적절히 제한을 해야 할 것이다. 이에 비추어 향후 집시법상 집회‧시위의 소음 규정들은 다음과 같이 입법적으로 개선하는 것이 바람직하다. 먼저 집시법 시행령 2조 2호에서 ‘확성기의 종류’를 신설하여 경찰이 사전에 집회‧시위자가 사용할 확성기의 종류에 의한 소음 크기에 대하여 적절한 조치를 할 수 있게 개선해야 하고, 집시법 24조 4호에서 과태료를 부과할 수 있도록 개선해야 한다. 그리고 집시법 14조에서 해당 집회‧시위의 소음에 대하여 실질적인 책임자를 정하는 규정을 신설하는 것이 바람직하다. 그리고 집시법 시행령 14조의 별표 2 규정에서 집회‧시위 소음의 발생 지속시간과 그 정지시간의 기준에 대한 규정을 신설해야 하고, 집시법 시행령 14조 1항 및 별표 2의 3호 규정에서 집회‧시위자들이 단시간 동안에 매우 큰 소음을 반복적으로 방출시 이에 대한 적절한 규제 조치 규정을 신설하는 것이 바람직하다. 이밖에 집시법상 2개 이상의 인접한 단체의 집회‧시위의 소음이 혼재되어 매우 큰 소음을 유발시 각각의 집회‧시위 단체별로 경찰관들을 배치하여 해당 단체들 중 1개의 단체의 집회‧시위의 소음만 남겨두고 나머지 단체의 집회‧시위의 소음을 방출하지 못하도록 하고 해당 단체의 집회‧시위 소음을 측정할 수 있는 규정을 신설하는 것이 바람직하다.
A Study on the Legislative Improvement Based on the Noise Measurement Regulations of Assembly and Demonstration in the Statute on Assembly and Demonstration
Regarding the issue of conflicting basic rights between the assembly and the protesters and others due to noise generated by rallies and demonstrations, it is desirable to improve the noise regulation of future assemblies and demonstrations in accordance with the Constitution's principle of actual harmony. First of all, it is desirable to create a new type of ‘type of loudspeaker’ in Article 2 of the Enforcement Decree of the same law. It is desirable to improve the law so that police can impose fines in Number 4 of Article 24 of the same law. In Article 14 of the same law, it is desirable to improve the organizers, the moderator, and the liaison officer of the rally to be responsible for the noise of the protest. And in the future, it is desirable to create new regulations to regulate the duration and duration of noise generated by meetings and demonstrations in the second Schedule of Article 14 of the same Enforcement Decree, and the duration of noise generated by those stops, as well as repeated noise from very large rallies in a short period of time. In addition, it is desirable to improve the noise of gatherings and demonstrations by the police in each group if the noise of gatherings and demonstrations of two or more neighboring groups is mixed and the noise of gatherings and demonstrations is not acceptable in the future in the second Schedule of Article 14 of the same law.
