정보기관에 대한 의회의 통제 강화 - 독일의 연방정보원(BND)에 대한 통제를 중심으로 -
2000년대 초반부터 7년간 수 많은 사상자와 피해자를 발생시킨 일련의 테러활동에 관련된 독일 내 극우단체인 소위 국가사회주의 지하조직(NSU)에 대한 정보기관의 수사활동에 대한 독일 연방의회의 조사위원회 활동, 2013년 스노든의 폭로로 밝혀진 미국 중앙정보국(CIA)과 국가안보국(NSA)의 감시활동에 대한 독일 연방정보원의 대응을 조사하기 위한 연방의회 조사위원회 활동이 시작되면서, 독일내에서는 정보기관에 대한 통제가 중요한 사회적·법적 문제로 제기되고 논의되었다. 독일은 2016년 연방정보원법의 개정을 통해 기존의 의회통제기관인 의회감독위원회의 활동을 강화하고, 다른 한편 연방정보원의 해외첩보활동을 통제하기 위한 기구로서 독립위원회 제도를 도입하였다. 연방정보원법 개정을 통해 새롭게 도입된 제도로는 상임위원(Ständiger Bevollmächtigte) 제도가 있다. 상임위원은 의회감독위원회의 지시에 구속되면서 의회감독위원회의 업무를 지원하는 업무를 담당함으로써 의회감독위원회의 연방정보원 통제활동을 강화하고자 만든 제도이다. 그 밖에도 의회감독위원회 위원장을 호선함으로써 위원회의 독립성을 강화하고자 하였다. 비밀유지의무 때문에 회의를 통해서만 의결했던 절차를 완화하여 감독위원회의 사무처리를 서면이나 전자문서를 통해 할 수 있도록 개선하였다. 일반적으로 비공개로 이루어지는 감독위원회 회의를 유지하는 대신 매년 연방정보원장을 대상으로 공개적인 청문회를 개최하고, 의회감독위원회에서 작성한 보고서를 일정한 요건 하에서 다른 기관에서도 활용할 수 있도록 전달할 수 있도록 개선하였다. 또한 연방정부가 의회감독위원회에 보고해야 하는 “특별한 의미가 있는 사안들”의 경우를 구체적으로 예시하고, 연방정부의 권한에 속하지 않는 사무에 대해서도 정보를 획득하여 전달할 수 있도록 연방정부의 의무를 확대하였다. 의회감독위원회가 앞으로는 사전에 고지하고 조율할 수 있다면 연방정보원을 상시 방문할 수 있도록 개선하였고, 내부고발자에 대한 보호제도를 강화하였다. 개별적으로는 각 제도마다 비판점이 있지만, 전체적으로는 독일의 중요한 외교·안보에 관한 중요한 정보수집활동과 비밀이라는 헌법적 이익을 유지하면서, 의회감독위원회의 활동을 강화하여 정보기관의 민주적 정당성을 제고함으로써 민주적 법치국가원리를 구체적으로 실현하고 강화하려고 노력했다는 점에서 독일의 연방정보원법 개정은 긍정적으로 평가할 수 있다. 국가정보원의 개혁에도 이를 반영한다면, 국회의 민주적 통제를 강화하고 국가안보를 위한 정보수집활동의 비밀을 유지할 수 있는 헌법적 균형성이 견지되는 개선이 가능할 것으로 보인다.
Reinforcement of the parliamentary control of the intelligence service
After the hectic and sensitive legal and social debate on the unresolved role of the Cconstitutional Protection Institution in the terrorism complex "Nationalsozialistischer Untergrund" and the revelations of Edward Snowden, the german Bundestag on 21 October 2016, made a comprehensive reform for the activity of the german Federal Intelligence Service (BND) and their Control. On the one hand, the legislature has developed many layers of legislation aimed at further strengthening the parliamentary control of the intelligence service. On the other hand, he has created a new sui generis supervisory body with the so-called "Unabhängigen Gremium(Independent Body)", which can legally review the so-called "foreign-foreign-telecommunications" practice by the BND. As the key of the reform is the Ständiger Bevollmächtigte(Permanent Representative), who, as an officer bound by instructions, permanently supports the Parlamentarische Kontrollgremium(Parliamentary Control Board) in addition to supporting the Vertrauensgremium(Trust Board) in BHO. In the future, the panel may also pass resolutions outside of meetings by written or electronic circular procedure. Now, unlike the Committees of the german Bundestag, the Parliamentary Contol Board can elect itself the chairmanship, thus strengthening the independence of the Board. Like the Parliamentary Armed Forces Commissioner, the Parliamentary Control Board has the right to be admitted to the BND's services, but not the right to an unannounced visit. The meetings of the panel are always secret, but future annual public hearings of the presidents of the BND are planned public. In addition, the legislature has improved some points, for example, a concrete description of the "events of particular importance" to which the Federal Government is committed. In the case which is not entitled to dispose of it, it also undertakes to take measures so that it can lend the information to the Parliamentary Control Board. Under certain conditions, the panel may also provide the report or information already referred to elsewhere. Finally, whistleblower protection is also improved. Regardless of some criticisms in detail, the reform of the parliamentary control of the BND is on the whole positive. The german legislator takes over the responsibility for the authorization of the activity of the BND and thus fulfills the democratic and constitutional mandate enough. The BNDG amendment is also helpful and suggestive for reform of the Korean National Intelligence Service (NIS).
