코로나19 이후 이민정책 및 법제변화의 전망

1990년대 중반 이후부터 본격적으로 통용되기 시작 세계화 또는 글로벌리즘 추세는 변하지 않을 대세로 여겨졌다. 그런데 세계화가 의미하는 바는 결국 높은 개방성과 국가 간의 인적 및 물적 이동성(mobility)이며 더 나아가서는 이민으로까지 이어진다. 따라서 올해 들어 세계를 휩쓸고 있는 팬데믹으로 인해 이민정책과 법제는 여러 측면에 있어 영향을 받지 않을 수 없는 구조이다. 요컨대, 이동의 제약으로 말미암아 팬데믹 상황과 가장 연관되는 쟁점이 바로 외국인, 이주, 이민정책 그리고 이민법제인 것이다. 따라서 코로나19는 단기적으로는 방역, 방역주권의 문제로 나타나지만 장기적으로는 개별국가의 인력수급의 문제이고 보다 거시적으로는 세계적인 이동성, 효율적 인력의 관리라는 측면에서 심각한 변화를 야기하고 있다. 주목할 점은 코로나19라는 비상사태를 극복하는 과정에서 국제사회의 정책적 연대의 약화, 또 다른 연관에서 민족주의의 대두 및 외국인에 대한 차별이 부각되었다는 점이다. 이러한 문제인식 하에 본 연구에서는 팬데믹이 초래한 주권기능의 변화 및 코로나19 이전의 이민법제와 코로나19 이후의 이민법제의 쟁점이 어떠한 차별성을 가지고 있는지 살펴보고 포스트 코로나19 시대의 이민법제의 과제를 전망해 보았다. 팬데믹 상황이 아직 진행 중이고 정책과 법제의 전망을 하는데 있어 연구의 현실적인 제약이 분명 존재함에도 불구하고 이번 재난은 또 다른 팬데믹의 예고일 수 있기 때문에 미래를 위한 준비라는 점에서 본 연구의 중요성이 강조된다고 하겠다.

Prospects for Changes in Immigration Policy and Legislation after Covid-19

The trend of globalization or globalism, which began to become popular in earnest after the mid-1990s, was seen as a trend that would not change. However, globalization means high openness, human and material mobility between countries, and furthermore immigration. Thus, due to the Pandemics sweeping the world this year, immigration policy and legislation are in many ways unaffected. In short, due to restrictions on movement, the issues most related to the Pandemics situation are foreigners, migration, immigration policy and immigration legislation. Therefore, Covid-19 appears to be a problem of quarantine and quarantine sovereignty in the short term, but in the long term, it is a matter of the supply and demand of manpower in individual countries, and more broadly, it is causing serious changes in terms of global mobility and efficient management of human resources. It is noteworthy that the weakening of international policy solidarity, the emergence of nationalism and discrimination against foreigners were highlighted in the process of overcoming the emergency of Covid-19. Under this recognition of the problem, the study looked at the differences between the changes in the function of sovereignty caused by Pandemics and the issues of pre-Covid-19 and post-Covid-19 immigration legislation and foreseen the challenges of post- Covid-19 immigration legislation. Despite the fact that the Pandemics situation is still in progress and that realistic limitations of research exist in predicting policies and legislation, the importance of this research is emphasized in that it is a preparation for the future as this disaster could be a preview of another Pandemics.
