사적(私的)규범의 입법적 활용에 관한 소고

의회입법의 한계는 해묵은 논의이지만 기술 분야 규범에서는 민간이 규범제정권의 실질을 주도하거나 민간이 만든 규범을 입법으로 수용하는 방식으로까지 확장되고 있다. 이러한 경향은 기술 규제의 국제통용성 확 대와 산업경쟁력 강화 측면에서 점점 강조되고 있다. 기술 분야에서의 입법과 규제는 원칙허용·사후규제 방식으로의 전환을 추진하는 것을 원 칙으로 명문화하는 등 기존의 입법적 틀에서 벗어나 새로운 방향으로 모 색이 필요한 상황이다. 이러한 배경에서 전문적·시의적 규율이 필요한 기술 분야의 입법부담을 경감하는 것은 물론 최신의 기술발전을 유도하 는 차원에서 바람직한 입법사례로 재평가되고 있는 독일의 사례를 살펴보는 것은 의미가 있다. 독일에서는 기술법에서 각종 기술적 기준을 직 접 규정하는 대신 준용(참조)하는 기술을 통하여 사적(私的) 기준을 법규 범에서 활용하고 있다. 이러한 입법적 기법을 통하여 민간에서 만든 기 술규범이 수범자에게 간접적 형태로 구속력이 인정될 수 있는 법구조를 취하고 있다. 이는 기술 분야의 규제 및 입법의 변화를 도모하고 있는 국내법제상 각종 기술규범의 제정과 활용을 어떻게 할 것인가를 정하는 데 시사점을 줄 수 있다.

Brief study on the legislative usage of private norms - Focusing on German Technical Regulations -

The limitations of parliamentary legislation are long-standing discussions, but in the technical field, the private sector takes the lead in the reality of the rule-making authority, or it is extended to a way of accepting the norms made by the private sector in legislation. These trends for technical regulations have been considered crucial for the expansion of international applicability and strengthening of industrial competitiveness. Since legislation in the technology sector also requires the transition of principles to ex-ante permission and post control, at least in the technical area there is a need to move away from existing legislative practice to find new methods. With this background, it is meaningful to review the German case, which is being reevaluated as a desirable legislative case to reduce legislative burden in the technical field that requires professional and timely regulation as well as inducing the latest technological development. In German technical law rather than directly specifying various technical norms, private norms are being used by using the legislative method applied mutatis mutandis(reference). Through this legislative method, the technical norms made by the private sector can be indirectly recognized as binding. This discussion is expected to provide implications for the technical sector that is particularly aiming to change domestic regulations and legislative methodology for various technical norms.
