주요 선거제도에 관한 일고찰 - 비례대표제와 사전투표제를 중심으로 -
오늘날 정당국가화 경향이 점증하고 있는 이 시점에서 대의원리의 실 현과 그를 통한 민주적정당성의 구현은 다름 아닌 선거에서 시작하여 선 거로 귀착된다고 할 수 있다. 즉, 이는 오늘날 선거제도가 당해 국가에 서 어느정도의 합리성과 정당성을 가지고 대의원리를 구현하느냐의 문제 로서 이를 위해 많은 국가들은 시대적·사회적 요청의 변화에 맞추어 선 거제도의 지속적인 개정을 추구하고 있다. 그리고 이 같은 선거제도의 합리성과 정당성의 제고는 궁극적으로 주권자인 국민의 의지를 대표자선 출에 어느정도 비례적으로 반영하느냐가 매우 주요한 관건이 된다고 할 수 있으며, 이의 대표적인 것이 바로 비례대표제라고 할 수 있을 것이 다. 또한 이 같은 비례성의 제고와 함께 무엇보다도 간접민주주의 내지 대의제에 대한 민주적정당성의 확대방안으로서의 주권자(유권자)의지의 최대화 역시 매우 중요하다고 할 수 있는 바, 이를 위한 다양한 제도 중 의 대표적인 것이 바로 우리의 사전투표제도라고 할 수 있을 것이다. 따 라서 이 같은 측면에서 본다면 오늘날 비례대표제를 통한 선거제도의 합 리성과 정당성을 제고하기 위해서는 사전투표제를 통한 주권자(유권자) 의지의 최대화가 필요적 요건으로서 상호 간 깊은 연관성을 가진다고 볼 수 있을 것이다. 이를 전제하면서, 본 고찰은 우선 건국이래 선거제도의 다양한 변천을 살펴보았으며, 이를 통해 우리의 선거사가 어떻게 변해왔는지, 전국구제 의 도입과 이후의 비례대표제의 도입 및 오늘날의 1인2표제의 도입 등 에 대해 살펴보았다. 이어서 비례대표제에 대한 고찰을 통해 대의제의 구현에 있어서 왜 비례대표제가 등장하게 되었으며, 이 같은 비례대표제 의 현대적 의미와 존재의 필요성에 대해 살펴보면서, 비례대표제를 우리 가 제도적으로 도입하게 된 선거사적 경위와 2020년 1월에 변경된 혼 합형(준연동형＋병립형)비례대표제의 적용례, 2표병립형과 연동형의 적용 효과 그리고 지역패권주와의 연관성 및 비례대표의석의 배분방식으로서 의 돈트(d'Hondt)식, 헤어니마이어(Hare/Niemeyer)식 및 샹레그쉐퍼 (Sainte-Laguë/Schepers)식에 대한 기본적인 고찰 등을 토대로 향후 우리의 새로운 의석배분방식에 대한 방안을 찾아보았다. 다음으로 사전투표제에 관해서는 도입취지와 사전투표제의 편의성과 투표율, 편의성으로서의 거리비용과 시간비용의 효용성, 사전투표제의 공적비용에 대한 민주적정당성의 무게 및 유권자의지의 왜곡가능성 등을 고찰해 봄으로써 사전투표제에 대한 또 다른 측면에서의 고민과 방안을 찾아보고자 노력하였다.
A Study on the Proportional Representation System and Pre-Voting System
This paper critically studied proportional representation and pre-voting. In particular, the reason why we focused on proportional representation and pre-voting is that the two systems are inherently very deeply related. In other words, the most important value of elections in today's representative democracy is democratic legitimacy. However, representatives elected from constituencies have limitations in their democratic legitimacy. Therefore, the most common way to overcome this is to strengthen proportional representation and maximize the will of the sovereign. To this end, this study first looked at various changes in the election system since the founding of the Republic of Korea. And I looked at the process of adopting proportional representation and the linked proportional representation in our election history. Next, I looked at d'Hondt, Hare/Niemeyer, and Saint-Laguech/ Schefs as the distribution method of proportional representation seats. And based on this, I looked at our new way of distributing proportional representation seats in the future. As for the pre-voting system, I looked at the concept and the purpose of adoption. And I looked at the convenience and utility of voting by adopting a pre-voting system. I also looked at the democratic legitimacy of the huge campaign costs of pre-voting, how much pre-voting contributes to raising voter turnout, and the distortion of the sovereign's true will in voting. This confirmed that we need to think more about how to improve and develop the pre-voting system in the future.
