유럽인권협약 제2조 생명권의 해석과 적용에 관한 연구 - 유럽인권재판소 결정례를 중심으로 -
본 연구는 유럽인권협약이 보장하는 권리 중 가장 중핵적인 제2조, 즉 생명권에 대한 해석과 적용에 대하여 검토하고자 한다. 생명권은 모 든 인간이 태어나면서 가지게 되는 가장 기본적이고 중요한 권리이다. 이는 사람의 생명을 보호하고, 그 생명을 무단으로 박탈당하지 않도록 하는 권리를 의미한다. 모든 국가와 사회의 기본 원칙은 개인의 생명을 존중하고 보호하는 데 있으며, 이러한 원칙은 국제적으로도 인정받고 있다. 생명권의 보호 이유는 여러 가지로 볼 수 있다. 첫째, 생명은 개인 에게 가장 소중한 자산이기 때문에 그 자체의 중요성에서 보호해야 한 다. 둘째, 사회적 차원에서 보면 생명의 존중은 사회의 안정과 발전을 위한 기본 조건이며, 생명권이 보장되지 않는 사회는 궁극적으로 혼란과 붕괴 위험에 직면할 수 있다. 셋째, 윤리적 관점에서는 모든 생명은 그 자체로 가치가 있으며, 인간이나 국가가 그 가치를 임의로 박탈하는 것 은 허용될 수 없다. 이와 같이 생명권은 모든 인간의 기본적인 권리를 대표하며, 이에 대 한 적절한 이해와 보호가 개인의 자유와 인권 존중의 기본적인 토대라는 것은 어떠한 국가와 지역을 불문하고 공통적으로 인식하고 있다. 유럽인 권협약은 유럽 지역에서 인간으로서의 기본적인 권리와 자유를 보장받을 수 있도록 하는 중요한 문서이다. 유럽인권협약 제2조인 생명권은 이러 한 협약의 핵심이며, 모든 인간이 가진 기본적인 권리 중 하나를 보장한 다. 하지만, 이 생명권에 대한 이해와 적용은 다양한 사회적, 정치적 맥 락에서 복잡한 이슈를 일으킬 수 있다. 이러한 이유로, 본 연구는 생명 권의 복잡한 문제들에 대한 깊이 있는 검토를 하고자 한다. 본 연구의 목표는 유럽인권재판소의 결정례 통하여 생명권이 인간의 존엄성을 보장하고 사회적 공정성을 추구하는 데 어떠한 역할을 하는지 를 검토하고자 한다. 이를 기반으로 생명권에 대한 일반적인 개념과 유 럽인권재판소의 생명권에 대한 해석을 소개하고, 이를 통해 생명권의 이 론과 실제 사이의 차이점을 좁혀 나가는 방안으로 고찰하고자 한다.
A Study on the Interpretation and Application of Article 2 of the European Convention on Human Rights - Focusing on the Case Law of the European Court of Human Rights -
This study examines the interpretation and application of Article 2, the right to life, which is one of the most central rights guaranteed by the European Convention on Human Rights. It is universally recognized that the right to life represents a fundamental right of all human beings and that its proper understanding and protection is a fundamental basis for individual freedom and respect for human rights. The European Convention on Human Rights is an important document that ensures that individuals in Europe are guaranteed their fundamental rights and freedoms as human beings. Article 2, the right to life, is at the heart of the Convention and guarantees one of the most fundamental rights that every human being has. However, the understanding and application of this right to life can raise complex issues in different social and political contexts. For this reason, this study aims to provide an in-depth examination of the complexities of the right to life. The aim is to examine the role of the right to life in ensuring human dignity and promoting social justice through the case law of the European Court of Human Rights. Based on this, the general concept of the right to life and the interpretation of the right to life by the European Court of Human Rights will be introduced in the next chapter, followed by an analysis of the Court's main decisions, with the aim of bridging the gap between the theory and practice of the right to life.
